1. Scope

The following terms and conditions apply to all orders placed via all of our own sales channels, such as our online shop. Our online shop is aimed exclusively at consumers. A consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contracting parties, conclusion of contract

The purchase contract is concluded with Sport Options AG (hereinafter referred to as "SO"). The presentation of the products in the online shop, as well as in catalogs and on technical sketches does not constitute a legally binding offer. Products may differ in their quality, fit and color if these deviations serve to improve the quality or cannot be implemented differently in production. If the customer does not revoke the order within five working days of receiving the order confirmation, the order confirmation is deemed to have been accepted. Oral side agreements require written confirmation from SO to be effective.

2.1 Online shop

In our online shop, you can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. By clicking the order button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been submitted.

2.2 Resellers

RRPs are recommended retail prices. The agent or reseller is not authorized to conclude contracts for the delivery of contractual goods that are binding for the supplier. Resellers may only sell goods purchased from SO within the framework agreed with SO. This applies in particular to the BZ PLZ Club.

3. Delivery period and delivery conditions

Stock items arrive at the delivery location within 2-5 working days. Orders received by SO by 2 p.m. are dispatched on the same day. Unless an expressly binding delivery date has been agreed, delivery dates are only non-binding information. The start of the delivery time specified by SO requires the timely and proper fulfillment of the customer's obligations. In the event of force majeure events or other operational disruptions through no fault of our own (including those of suppliers) that make delivery impossible - e.g. industrial action, official orders, etc. - the final delivery date can be postponed by the duration of the disruption plus a start-up time of 14 days. If the disruption lasts longer than 5 weeks and SO does not inform the customer immediately of this delay, the customer can withdraw from the contract. Mutual claims for damages are excluded in such a case. The customer can request SO in writing to deliver within a reasonable period of time two weeks after a non-binding delivery date/delivery period has been exceeded. If SO fails to meet an explicit delivery date/delivery deadline through its own fault or falls behind schedule for any other reason, the customer must grant SO a reasonable grace period to provide the service. If SO allows the grace period to expire without result, the customer is entitled to withdraw from the purchase contract.

4. Prices and payment

5. Warranty

Complaints must be reported to SO in writing within 14 days of receipt of the goods. In the case of hidden defects, the provisions of the Swiss Code of Obligations apply. Customary or minor technically unavoidable deviations in quality, color of the fabric, equipment, fit or design as well as minor fashion changes are not considered defects and do not entitle the customer to warranty claims. Defective goods that are reported to SO in a timely manner will be taken back by SO for repair or replacement. If the defect cannot be remedied in this way, SO will arrange for a replacement delivery in a timely manner. If the defect-free replacement delivery is not made within a reasonable period of time, SO will refund the price of the returned goods as agreed.

6. Ownership and retention of title

SO retains ownership of the goods delivered under the delivery contract until the purchase price (including additional claims) has been paid. SO retains ownership and copyright of all documents provided in connection with the order, such as calculations, drawings, etc. These documents may not be made accessible to third parties unless SO gives the customer its express written consent.

7. Law and jurisdiction

Swiss law applies. The place of jurisdiction for all disputes is CH-5600 Lenzburg (AG).
